Mortgage refinancing: when should you contact a notary?
Mortgage refinancing may require the services of a notary when your mortgage term comes to an end, and you still have a balance to pay off. You may also want to renew your mortgage to do renovations, consolidate your debts or benefit from more favourable loan terms.
After signing your loan agreement and completing the process for a new mortgage loan with your bank, you’ll need to provide them with the name of your notary to finalize your mortgage refinancing. The bank will then forward us your file. When we receive it, we’ll do the necessary verifications and contact you as quickly as possible to schedule a meeting.

Discharging a mortgage
When you finish paying off your mortgage loan, you’ll want to have the debt officially discharged from the land register. If not, the bank holds the property as collateral. This is because repaying your mortgage in full does not automatically cancel it.
To release your property from being considered collateral and from the mortgage debt, you must contact your notary. They will prepare what is called a discharge, have it signed by the creditor and publish it in the Quebec Land Register.

Sometimes it is necessary or desirable to transfer ownership of a property to another person. This may be the case when you refinance, divorce or separate, for example. You may also want to transfer a property to your children during your lifetime.
